Terms and Conditions – Anna’s Light

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can make use of their right of withdrawal (only applicable if not exempted).
  • Consumer: a natural person not acting in the exercise of a profession or business who enters into a distance contract with the entrepreneur.
  • Day: calendar day.
  • Durable data carrier: any tool – including email – that enables the consumer or entrepreneur to store information in a way that allows future consultation or use.
  • Right of withdrawal: the consumer's possibility to withdraw from the distance contract within the cooling-off period (subject to limitations).
  • Entrepreneur: Anna’s Light, offering artworks and jewelry through distance sales.
  • Distance contract: a contract concluded within the scope of an organized system for distance selling, without physical presence of the entrepreneur and the consumer.

Article 3 – Applicability

These general terms and conditions apply to every offer from Anna’s Light and to every distance contract concluded between Anna’s Light and the consumer.

Article 4 – The Offer

  1. Offers are non-binding and subject to availability.
  2. Custom pieces are made by hand and may vary slightly in color, texture, and finish.
  3. Photos are indicative. Slight deviations do not entitle the consumer to any compensation or right of return.
  4. Anna’s Light reserves the right to alter prices or discontinue products at any time.

Article 5 – The Agreement

  1. The contract is concluded at the time of acceptance by the consumer and confirmation by Anna’s Light.
  2. Orders are only accepted after full payment unless otherwise agreed.
  3. The entrepreneur takes appropriate technical and organizational measures to secure electronic data.

Article 6 – Right of Withdrawal

No right of withdrawal applies to:

  • Custom, made-to-order, or personalized products (including all handmade jewelry and artworks).
  • Products which by nature cannot be returned.

By purchasing from Anna’s Light, the consumer agrees that these goods are excluded from the statutory right of withdrawal.

Article 7 – Returns and Refunds

  1. Only non-custom, ready-made products may be returned, and only if:
    1. The return is requested within 7 days of delivery.
    2. The item is unused and in original condition and packaging.
    3. The consumer provides photographic evidence of any defects or shipping damage within 48 hours of receipt.
  2. The consumer is responsible for return shipping costs.
  3. Refunds (if applicable) will be issued within 14 days after the returned item is received and approved.
  4. Refunds are made via the original payment method unless agreed otherwise.
  5. No refunds or exchanges are given for custom work, commissioned pieces, or any items marked as final sale.

Article 8 – Liability

  1. Anna’s Light is not liable for any damage resulting from:
    1. Misuse or mishandling of the product
    2. Allergic reactions
    3. Delays or failures caused by third parties (e.g. postal services)
  2. The liability of Anna’s Light is always limited to the amount of the order in question.
  3. Under no circumstances shall Anna’s Light be liable for indirect damages, consequential damages, or loss of profits.

Article 9 – Prices and Payment

  1. All prices include VAT unless stated otherwise.
  2. Payments must be made at the time of ordering unless otherwise agreed.
  3. In case of late payment, Anna’s Light is entitled to cancel the order.

Article 10 – Conformity and Warranty

  1. Products shall meet the specifications stated in the listing.
  2. Variations inherent to handmade or artistic work are not considered defects.
  3. Warranty is limited to manufacturing defects notified within 14 days.
  4. No guarantee is given for fitness for a specific purpose unless explicitly stated.

Article 11 – Delivery and Fulfillment

  1. Delivery times are estimates and not guaranteed.
  2. Delays do not entitle the consumer to cancel or claim compensation.
  3. The risk of damage or loss transfers to the consumer upon delivery.

Article 12 – Duration and Termination of Contracts

  1. No subscriptions or recurring contracts apply.

Article 13 – Complaints

  1. Complaints must be submitted in writing within 7 days of delivery.
  2. Anna’s Light will respond to complaints within 14 days.
  3. If a dispute cannot be resolved, the consumer may contact the Dutch ODR platform (http://ec.europa.eu/odr).

Article 14 – Governing Law

  1. These terms are governed exclusively by Dutch law.
  2. The Vienna Sales Convention does not apply.

Article 15 – Final Provisions

  1. If any part of these terms is found to be invalid, the remaining provisions remain in effect.
  2. Deviations from these terms are only valid if agreed in writing.

Article 16 – Authenticity of Reviews

  1. Reviews shown on the website reflect actual customer feedback.
  2. No incentives are given in exchange for reviews.
  3. Anna’s Light reserves the right to moderate or remove offensive or irrelevant reviews.
